The safe containing Knowledge House e–mails is about to be cracked.
National Bank and other parties, being sued by Knowledge House and its CEO Dan Potter, have the right to see the failed e-learning company e-mails that include solicitor-client communications, Nova Scotia Supreme Court judge has ruled.
The public company, based in Halifax, went under in September 2001, after its stock plunged on the Toronto Stock Exchange.
However, in a decision released Thursday, Justice Ted Scanlan said that waiving solicitor-client privilege and allowing use of e-mails, does not extend to criminal and securities proceedings involving Knowledge House.
"There is currently an RCMP investigation and a Nova Scotia Securities Commission proceeding. It is not my intention at this juncture to rule on the issue as to whether the suit by Potter and KHI (Knowledge House) would result in a waiver of privilege in those matters," Justice Scanlan said in his decision...
