 Defunct firm sues province

A bankrupt Dartmouth broadband company is suing the province for allegedly using its business model to provide high-speed wireless services throughout Nova Scotia.

In a notice of action filed with the Supreme Court of Nova Scotia on Feb. 1, 2008, lawyers for TDC Broadband Inc. allege that the provincial government used the firm’s exclusive property as a model to solicit proposals to provide wireless broadband service in rural Nova Scotia.

The notice says that TDC had, prior to the government’s 2007 request for broadband service proposals, developed the technology and a plan to provide wireless services in Caledonia, Queens County, and to other parts of the province, including Cumberland County.

In addition to alleging the province used technology and a business model it didn’t own, TDC claimed it suffered further damages when it was not awarded a contract after submitting a bid on the province’s broadband services tender...
